Canon 694

§1
Can. 694 §1. A member must be held as ipso facto dismissed from an institute who:
1º has defected notoriously from the Catholic faith;
2º has contracted marriage or attempted it, even only civilly;
3º has been illegitimately absent from the religious house, pursuant to can. 665 §2, for twelve consecutive months, taking into account that the location of the religious himself or herself is unknown.
§2
Can. 694 §2. In these cases, after the proofs have been collected, the major superior with the council is to issue without any delay a declaration of fact so that the dismissal is established juridically.
§3
Can. 694 §3. In the case envisaged by §1, n. 3, in order to be established juridically, this statement must be confirmed by the Holy See; for institutes of diocesan right the confirmation rests with the bishop of the principal seat.
